We may update these Terms from time to time by publishing a revised version on our website. Changes apply from the date they are published and do not retrospectively change the terms applicable to a purchase already completed, except where required by law or agreed with the customer.

Prices displayed on the website are in Australian dollars unless otherwise stated.
Where applicable, Australian prices include GST.
International orders may be treated differently for GST purposes where applicable.

Section 6: Orders and Order Acceptance
Submitting an order through our website and receiving an automated order confirmation does not necessarily mean the order has been accepted for fulfilment.
In most cases, orders are processed normally without further review.
However, in limited circumstances we may need to decline, modify or cancel an order. This may occur where:
- stock is unavailable;
- there is an obvious pricing or website error;
- payment cannot be verified;
- fraud or unauthorised activity is reasonably suspected;
- an item cannot legally be supplied or transported;
- Dangerous Goods restrictions prevent delivery;
- international import or shipping restrictions apply;
- incorrect product information materially affects the order;
- unusually large quantities have been ordered;
- a product has been discontinued; or
- another circumstance prevents us from reasonably fulfilling the order.
If we need to cancel or materially change an order, we will make reasonable efforts to contact you using the details supplied with the order.
Where payment has already been received for goods that we cannot supply, any applicable refund will be processed in accordance with our policies and applicable law.

Products sourced or manufactured overseas, including products manufactured in Italy, may also include manufacturer warranties. Any manufacturer warranty operates separately from rights that apply under Australian law.
Nothing in this section is intended to exclude, restrict or modify a right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, you agree to indemnify The Artisans Bottega against reasonable losses, liabilities and expenses arising directly from:

The remaining provisions will continue to apply.
Section 17: Suspension and Termination
We may suspend or terminate access to our website or services where we have reasonable grounds to believe that a user:

- is engaging in fraudulent or unlawful activity;
- is abusing our staff, systems or services;
- presents a security risk; or

Subject to any rights available under applicable law, disputes relating to these Terms are subject to the jurisdiction of the courts and tribunals of Victoria and the Commonwealth of Australia.

The current version will be published on our website.
Changes apply from the date they are published and do not retrospectively alter an order already placed and accepted unless required by law or agreed with the customer.
Continued use of the website after changes are published means the updated Terms will apply to subsequent use of the website.
Section 21: Click & Collect and Store Pickups
Customers must wait until they receive confirmation from The Artisans Bottega that their order is ready for collection before travelling to the selected store.
Customers are responsible for checking their email inbox and junk or spam folders for pickup notifications.
The person collecting an order should provide:
- valid photo identification; and
- the applicable order confirmation.
The name on the identification should match the customer or authorised collection person.
If another person will collect an order on your behalf, The Artisans Bottega may require confirmation of their authority to collect the order, together with identification and order information.
Uncollected Orders
Customers are responsible for collecting orders within a reasonable period after receiving notification that the order is ready.
The Artisans Bottega will make reasonable attempts to contact customers regarding outstanding collection orders, generally including follow-up contact on a weekly basis.
Customers are responsible for monitoring the contact details supplied with their order, including email inboxes and junk or spam folders.
If an order remains uncollected for more than 2 months and the customer has not responded to reasonable attempts to contact them, the order may be treated as abandoned.
Products may be returned to stock where appropriate.
Perishable, refrigerated or other products that cannot reasonably be returned to stock may be discarded.
No voluntary refund or exchange will be initiated for an order treated as abandoned after this period.

Section 22: Coupons, Promotions and Discounts
Coupons and promotional offers are subject to the individual conditions of the applicable promotion.
Unless expressly stated otherwise:
- coupons must be redeemed within the promotional period;
- coupons must be applied before checkout is completed;
- a coupon must be used in a single transaction;
- only one coupon or promotional discount may be applied to an order;
- coupons and promotions cannot be combined with other discounts or offers;
- further discounts do not apply to products already discounted;
- minimum spend or quantity requirements may apply;
- maximum redemption limits may apply;
- coupons have no cash value;
- coupons cannot be retrospectively applied to completed orders; and
- shipping charges are not discounted unless expressly included in the promotion.
Brand and Product Exclusions
All promotions are subject to brand and product exclusions.
Certain brands, products, categories, gift cards, clearance products, already discounted products or other specified items may be excluded from a promotion.
Applicable exclusions may be identified in the promotion, on the website or at checkout.
A promotion does not create an entitlement to an additional discount where a product is already discounted or otherwise excluded.
If specific promotional terms conflict with the general promotional conditions in this section, the specific terms published for that promotion apply.
Section 23: Calculators, Guides and Educational Information
The Artisans Bottega may provide calculators, recipes, guides, articles, instructions and educational resources relating to activities including food preparation, preserving, brewing, winemaking, distillation and other projects.
These resources are provided for general informational and educational purposes.
Calculations and results may be estimates and can be affected by factors including measurements, ingredients, equipment, environmental conditions, processes and information entered by the user.
Customers remain responsible for:
- checking calculations and measurements;
- following manufacturer instructions;
- following appropriate food safety practices;
- operating equipment safely;
- determining whether information is suitable for their particular circumstances; and
- complying with applicable laws and regulations.
Section 24: Distillation Equipment and Alcohol Distillation
The Artisans Bottega sells distillation equipment that may be suitable for lawful purposes including:
- water purification;
- essential oil extraction;
- other lawful distillation activities; and
- alcohol production where the purchaser holds all licences, permissions and approvals required by law.
Alcohol Distillation
Australian laws regulate the manufacture of spirits and other excisable alcohol.
Customers intending to manufacture alcohol are responsible for determining and complying with all applicable Australian Taxation Office requirements, excise requirements, licences and permissions.
The Artisans Bottega does not authorise, encourage or endorse the unlawful manufacture of alcohol.
Stills Greater Than 5 Litres
Australian Taxation Office requirements also apply to certain stills based on their capacity.
If you are not a licensed excise manufacturer, ATO permission is generally required to manufacture, move or set up, sell or buy, import, possess, have custody of or control a still with a capacity of more than 5 litres. (Australian Taxation Office)
Customers are responsible for determining whether ATO permission or another licence, registration or approval is required before purchasing, possessing, installing or using distillation equipment.
Purchasing equipment from The Artisans Bottega does not constitute approval, permission or a licence to use that equipment for a regulated purpose.
Requirements may change, and customers should check current requirements with the relevant government authority before purchasing or using distillation equipment.

Section 26: Australian Consumer Law
Nothing in these Terms & Conditions, our Returns, Refunds & Exchanges Policy, our Shipping & Delivery Policy or any other policy of The Artisans Bottega excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law.
Consumer guarantees apply automatically where applicable and operate independently of manufacturer warranties. (ACCC)
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. (ACCC)
The voluntary restrictions, exclusions, timeframes, restocking fees and other conditions contained in our policies apply only to the extent permitted by law and do not remove rights that cannot legally be excluded.
